Mobile Banking Terms and Conditions
Thank you for using the Mobile Banking Services (“Mobile Services”) and any related Software (“Software”) provided by Alabama One Credit Union (“Alabama One”) combined with your handheld’s text messaging capabilities. By participating in the Mobile Services or using the Software, you are agreeing to the following terms and conditions, in addition to any terms and conditions to which you have previously agreed with respect to the underlying electronic banking and online bill pay services of which the Service is a part. Alabama One in its discretion may modify these Terms and Conditions at any time. Message & data rates may apply.
Terms and Conditions:
a. Program: Alabama One offers their members mobile access to their account information (e.g., for checking balances and last transactions) over the Short Message Service (SMS), as well as the option to set up alerts for their accounts (e.g., low balance alerts) and/or alerts providing general product information from the Alabama One. Enrollment requires identification of the user’s banking relationship with Alabama One as well as providing a mobile phone number. The mobile phone number’s verification is done by the user receiving an SMS message with a verification code which they will have to enter on the website. Additionally, customers may select the type of alerts and other preferences which will determine, together with their account data, the frequency of alerts delivered to the customer. This program will be ongoing. Standard messaging charges apply. Members will be allowed to opt out of this program at any time. In order to remain eligible for the Mobile Service, member must remain in good standing.

c. To Stop SMS Alerts: To Stop SMS Alerts, login to your home branch account. Go to Account Services -> E-Alerts. There you can change settings on the alerts you receive.
d. Terms and Conditions: By participating in the Alabama One Mobile Banking program, you are agreeing to the terms and conditions presented here.
e. Service Available: The Services and/or Software may not be available at anytime for any reason outside of the reasonable control of Alabama One or any service provider.
f. SMS Communications: SMS communications will be sent to the mobile device you have registered for the Service. If you change your mobile device, you are responsible for informing us of that change.
Verizon Wireless, AT&T, Sprint Nextel, T-Mobile, TracFone, MetroPCS, Cricket are supported in addition to other US carriers.
Credit Union Liability
You understand and agree that SMS communications may be delayed or prevented by a variety of factors. Alabama One will do its best to provide SMS communications in a timely manner with accurate information. We neither guarantee the delivery nor the accuracy of the contents of an SMS communication. You also agree that we shall not be liable f or any delays, failure to deliver, or misdirected delivery of any SMS communication; or for any actions taken or not taken by you or any third party in reliance of an SMS communication. SMS communications are designed to assist in overall management of the account; the account holder should not be solely reliant on this service as delivery of messages can sometimes be delayed.
We shall not be responsible for any loss or damage caused by the Service. Nor shall we be responsible for any late fees, direct, indirect or consequential damages arising from the use or maintenance of the Mobile Service. The Mobile Service is provided “as is” without any warranty of any kind, either expressed or implied, including but not limited to the implied warranties of fitness for a particular purpose or warranties of merchantability.
Alabama One Credit Union, VISA INC. and their respective subsidiaries, affiliates, licensors, service providers, content providers, employees, agents, officers, directors and the manufacturer or your mobile phone will not be liable for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary, or other damages, including loss of revenue or income, pain and suffering, emotional distress, or similar damages, even if Alabama One Credit Union has been advised of the possibility of such damages. In no event will the collective liability of Alabama One Credit Union, VISA and their respective subsidiaries, affiliates, licensors, service providers, content providers, employees agents, officers, directors and the manufacturer of your mobile phone to any party (regardless of the form of action, whether in contract, tort, or otherwise) exceed $100.
In no event will Alabama One Credit Union be liable for any damages, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising from Alabama One Credit Union GoAO service or use thereof or inability to use by any party, or in connection with any failure or performance, error, omission, interruption, defect, delay, in operation or transmission, computer virus or line or system failure, even if we, or our representatives, are advised of the possibility of such damages, losses or expenses.
